PROCEDURES
FOR ENTRY & DEPARTURE
Immigration procedures are mandatory. This applies to French
boats arriving from other French departments as well. However, French
boats are not required to go through Customs unless they have goods
to declare.
Any boat that had
not yet gone through Customs must go to a port with Customs and
hoist the
yellow "Q" flag to request free pratique. As a general rule, the
captain must go through all procedures before any of the crew or
passengers may disembark. The captain must present the boat's original
registration papers (orange or blue registration book or the equivalent
for foreign boats, plus rental contract, proof of lending, etc.,
if applicable) and passports for the crew and/or passengers.
In
the French Antilles, these procedures are free. These procedures may be carried out in the following locations

Tax rates for Martinique and Guadeloupe : - VAT (usual rate) = 8.5% - Octroi de Mer tax = 7%
(local tax) - Additional tax = 2,5% in Martinique = 1,5 or 2,5% in
Guadeloupe
Commercial vessels (blue registration book) are tax-exempt.
Yachts being used for tourism are required to pay an additional
tax of 1,5%, but they are exempt from VAT. In Guadeloupe only they
are also exempt from the Octroi de Mer tax. In Guadeloupe, the additional tax for yachts not being used for
the development of tourism is 2,5%. The free ports in St. Barthelemy and St. Martin are a special
case in that there are no Customs procedures. However : French boats registered in St. Barthelemy and St.
Martin are required to be registered as French at the office of
Affaires Maritimes in Pointe à Pitre. Except in emergency situations,
these boats may not enter the waters of the French territories unless
they pay all applicable taxes (VAT, Octroi de Mer, and any additional
tax).

Documents (original and updated) required for a Customs inspection
: - certificate of registry - boat operator's license (motorboats) - passports for all foreign passengers - clearance for entry or departure - invoices for any equipment recently added to the boat or for
any merchandise on board
Reminder : - Procedures are free and mandatory. - Annual visits are obligatory for commercial boats (blue
registration book). Non-commercial yachts (orange registration
book) must be prepared to present the required up-to-date safety
equipment in the event of an inspection by the authorities. - Applicable laws are those of metropolitan France.
However : - French overseas departments are export territories and therefore
have a different system of taxation than that of metropolitan France.
